TRAFFIC COURT TIP OF THE DAY

Seatbelts everyone. It not just a tag line on a kids cartoon (remember The Magic School Bus) it’s the law. Every driver is responsible for their seat belt as well the proper restraint of anyone under the age of 16 who is a passenger. 

A driver is required to make sure that they are properly restrained by a seat belt. While a seat belt for a driver carries 0 points, it is a moving violation and can impact insurance rates.

Adult front seat passengers are responsible for their own seatbelts. Like a driver their tickets carry 0 points but, it is a moving violation and can impact insurance rates.

Seatbelt violations carry a fine of no less then $138.

Passengers birth to age 4 are required to be restrained in a federally approved child car seat. Children ages 4 till 8 are required to be restrained in a federal approved child booster seat, Children ages 8 till 16 are required to be restrained by a seatbelt. It’s the responsibility of the driver to make sure that children are properly restrained. The consequences are a fine and if the ticket is for a child under 16 it carries 3 points for each ticket. 

Right now rear seat adults are strangely exempt. However the law is about to change as the NYS legislature pass law making a rear seat adult responsible for their proper restraint.
